CCLA Lunchtime Seminar - Trust Law in Civil Law Asia: Taking Stock

Centre for Cross Border Commercial Law in Asia Trust law in Civil Law East Asia has developed along a distinctive path, shaped by historical diffusion and local adaptation. Doctrinally contractarian and obligational in structure, and long used almost exclusively for commercial purposes, civilian trust regimes diverge from the traditional common law model. These features reflect the trust’s transnational journey—eastward through British colonies and westward across North America and the Pacific—routes that converged in early twentieth-century Japan and continue to shape regional developments. What might appear anomalous instead reflects a complex interplay of doctrinal learning, legislative borrowing, colonial legacies, the international flow of capital, demographic transformation, and persistent legal-cultural norms. Centre for Cross Border Commercial Law in Asia This talk mainly focuses on the theoretical and structural analysis of HR DD laws (Human Rights Due Diligence laws), which is becoming and being more broadly recognized by not only scholars but also national legislators as well as private sectors as a kind of global trend. This trend has been crystalized at the EU CSDDD (Corporate Sustainable Due Diligence Directive) in 2024 and now under the consideration of amendments. It points out some deficits, or at least problematic points of CSDDD and other national domestic DD laws, taken under analytical scrutiny as exemplar cases, and give rise to questions about this global trend of DD laws in general, in terms of legal mechanism for regulating GVCs (Global Value Chains) and for improving the protection of human rights, environmental interests, and workers’ rights. SOSS - SEA Seminar | Destination cities in Asia: Interfacing migration and social mobility among urban middle classes

School of Social Sciences Long-standing scholarship on migration and cities has concentrated on migrants’ arrival, integration, and place-making practices, and how population movements impact urban areas. The MigrationRhythms project complements these studies by investigating how urban destinations figure in migration trajectories and quests for upward social mobility in Asia, highlighting the role of the urban in migration-development connections. This presentation draws from a multi-sited study on migration and middle-class families in Asian cities, analysing 106 family history interviews with residents in Hanoi, Manila, Karachi, and Mumbai. I discuss three key insights from our findings: first, the four cities may be labelled as ‘destination cities,’ with varying roles in internal/international migration trajectories. Second, they are also spaces that can mediate families’ upward social mobility.
